The paper presents different clustering approaches in legal judgments from the Special Civil Court located at the Federal University of Santa Catarina. The subject is Consumer Law, specifically cases in which consumers claim moral and material compensation from airlines for service failures. To identify patterns from the dataset, we apply four types of clustering algorithms: Hierarchical and Lingo, K-means and Affinity Propagation. We evaluate the results based on the following criteria: entropy and purity; algorithm's ability in providing labels; legal expert’s (...) evaluation; and experimental complexity. The results demonstrate that the most advantageous approach is Hierarchical Clustering, since it has the best entropy and purity numbers, as well as the least difficulty for the expert to analyze the clusters, and the least experimental complexity. The main contribution of the paper is to show the advantages and disadvantages of each approach, especially to identify labels in unstructured and non-indexed legal texts. (shrink)

A legislação florestal brasileira pretérita é frequentemente interpretada de forma anacrônica. O objetivo deste artigo é contribuir para a compreensão da historicidade de tal legislação. De forma específica, serão analisadas, comparativamente, as propostas de alteração do primeiro Código Florestal Brasileiro até sua substituição em 1965. Apesar de modificações importantes, há uma permanência entre os textos analisados: as posturas conservacionistas, presentes em todos eles, só podem ser compreendidas quando atreladas à lógica produtivista e às políticas desenvolvimentistas evidenciadas no Brasil da época.

ABSTRACTEmotion differentiation refers to the precision with which people can identify and distinguish their emotions and has been associated with well-being in adults. This study investigated ED and its relation with emotional well-being in adolescents. We used an experience sampling method with 72 participants to assess adolescents’ positive and negative emotions at different time points over the course of two weekends and a baseline questionnaire to assess emotional well-being. Differentiating negative emotions was related to less negativity intensity and propensity, and (...) to the belief that emotions are malleable. Differentiating positive emotions was not related to any of the assessed well-being variables. Together, these results suggest that a detailed awareness of one’s negative emotional states is an important dimension of well-being, also in adolescence. (shrink)

Esse estudo objetivou analisar a violência infantil no contexto brasileiro, correlacionando-a com fatores socioeconômicos, socioculturais, geracionais e de gênero, investigando o impacto dos mesmos na saúde das crianças. Realizou-se um estudo epidemiológico descritivo, realizado a partir de dados de artigos científicos e documentos oficiais sobre e violência infantil, além do banco de dados do Sistema de Informação de Agravos de Notificação (SINAN) e da plataforma SciELO e Google Acadêmico. Encontrou-se uma maior prevalência de violência física e negligência, maior índice de (...) violência sexual contra o sexo feminino e negligência no sexo masculino. Os principais agressores identificados foram o pai e a mãe. Acerca da etnia, crianças pardas foram as mais agredidas, bem como as de menor escolaridade. As consequências da violência infantil se estendem para além do momento da agressão, ao perturbar funções cognitivas e mesmo influenciar na gênese de transtornos psiquiátricos. (shrink)

In this paper we investigate a particular two-stage supply chain network design problem with fixed costs. In order to solve this complex optimization problem, we propose an efficient hybrid algorithm, which was obtained by incorporating a linear programming optimization problem within the framework of a genetic algorithm. In addition, we integrated within our proposed algorithm a powerful local search procedure able to perform a fine tuning of the global search. We evaluate our proposed solution approach on a set of large (...) size instances. The achieved computational results prove the efficiency of our hybrid genetic algorithm in providing high-quality solutions within reasonable running-times and its superiority against other existing methods from the literature. Depressive symptoms and disorders are major public health concerns, affecting many adolescents and young adults. Despite extensive research, depression prevention programs for youth show limited effectiveness. Moreover, the maximal potential of youth psychotherapy — on which depression prevention programs are based — may have been reached. Commercial video games may offer an engaging alternative vehicle for youth to practice emotional and social skills vital to mental health. The current study investigated the potential for the commercial video game Journey to prevent (...) the exacerbation of depressive symptoms. A pre-registered randomized controlled trial tested the effectiveness of Journey as an indicated depression prevention approach compared to a control game condition and a passive control condition. Additionally, potential action mechanisms for depression prevention using video games were examined. Participants aged 15 to 20 years old with elevated depressive symptoms were given 4 weeks to play Journey or the control game, Flower. Results showed no beneficial effects of playing the commercial video game, Journey, on youth’s change in depressive symptoms above and beyond the active and passive control conditions up to 12-months after the intervention. Additionally, no action mechanisms were found specifically for Journey. Nevertheless, over the whole study, participants decreased in depressive symptoms, became less sensitive to rejection, and experienced more hope and optimism. Moreover, participants who during the study decreased in rejection sensitivity or rumination or who increased in hope and optimism or in distraction and problem solving showed the strongest decrease in depressive symptoms. Although results do not support the use of the studied commercial game as an effective indicated depression prevention strategy, our results do suggest that rejection sensitivity, hope, optimism, rumination, distraction, and problem solving are promising targets for future depression prevention efforts. We conclude with important lessons for future research on games to promote mental health. Particularly, encouraging careful consideration of research designs to explore for whom and how potential action mechanisms and associated game mechanics may be effective. (shrink)

In the context in which the majority of Romanians are orthodox and the level of trust in Church is very high, this paper aims to analyze the level of political interference into religious life. The article focuses on particular aspects of political communication, namely the use of religious symbols and religious events in electoral campaigns. The main hypothesis of the research refers to the supposition that during the electoral years, the visibility of politicians presented by newspapers as attending religious events (...) is higher than in the rest of the time. Moreover, the paper aims to analyze if there is an overlapping between the years in which politicians are presented to attend more religious services and the years in which people have higher trust in Church. Inaugural speeches of U.S. Presidents are part of symbolic politics. They are part of the political traditions, and represent an important moment in presenting political visions for the future. The infusion of religious elements into politicians’ speeches becomes a tool in increasing the number of cast votes and the notoriety. This paper analyzes the inaugural speeches of both Republican and Democrat U.S. Presidents in the past twenty years, starting at the end of the Cold War until nowadays. In the last decades, scientific developments are largely discussed and debated mainly at the media level. Based on the agenda setting model, the importance of a certain theme is given by the frequency of its appearances in mass-media. Within this context, this paper focuses on the issue of stem cells and its media coverage in Romania. Using content analysis of the most read national newspapers, the research aims to emphasize two relevant aspects: the stem cells issue is only partly visible (...) in the written media and the debate between ethics and science is rather non-existent. The purpose of this paper is to present and analyse the biography of a passionate 20th century Romanian tourist who lived in Bucharest and travelled across Europe, bringing his (subjective) travel experiences of Western countries to private and public audiences curious about the unknown “abroad” during the 1980s. This case study is about the life and travel experiences of Vasile A. Marinescu, and deals with their visibility and interpretation during the communist era. The research is based on unpublished sources – (...) visual and audio sources, as well as manuscripts (between 1970 and 1980), interviews – and other already published archive materials. The research describes, in particular, how the West was perceived and presented in those semi-private shows, and how (and which of) those unofficial sources influenced the imagination of Romanians, aside the official propaganda. Recently there has been interest in examining how language is involved in the phenomenon of ‘manipulation’. This paper suggests that investigators, rather than treating ‘manipulation’ as an entity, should examine how communicators might engage in discursive acts of manipulating. To this end a distinction is made between manipulating information and manipulating people. Examples of both types, taken from the Portuguese Parliamentary Celebration of the April Revolution of 2004, are examined in depth to show how acts of manipulating can be performed (...) in different ways. By focussing on acts, we show that supposed ‘cognitive control’ over the audience's minds is not necessarily involved in manipulating; it is shown how investigators can provide evidence that manipulators act ‘knowingly’ when they mislead. We argue that the study of manipulating, and the distinction between manipulating information and people, provides a critical approach to the topic of political oratory. (shrink)

In a dissonance case, a person sincerely and with conviction asserts that P, while her overall automatic behaviour suggests that she believes that not-P. In contrast with several mainstream views, this paper defends the contradictory-belief view of some relevant dissonance cases and explores its consequences regarding Moorean propositions. The paper argues that in relevant cases, the dissonant person is justified in asserting a Moorean proposition on the grounds of her explicit view on the subject matter and the recognition of her (...) opposing beliefs. The person is irrational in being dissonant, but not in asserting a Moorean proposition. (shrink)

Jerry Fodor’s arguments against the possibility of concept learning, and the responses that have been offered in defense of the coherence of concept learning, have both by and large assumed that concept learning is a descriptive process. I offer an alternative, ostensive approach to concept learning and explain how descriptive concept learning can be explained as a version of ostensive concept learning. I argue that an ostensive view of concept learning offers an empirically plausible and philosophically adequate account of concept (...) learning that is explanatorily superior to traditional descriptive views. In recent decades, developing and middle-income countries around the globe have adopted path-breaking reforms to their social protection systems. Latin America has been a pioneer region, expanding the state’s commitment on behalf of low-income citizens in key policy areas in many countries. This paper undertakes two tasks. First, it documents the surprising extension of noncontributory social protection policies across many Latin American countries, highlighting how tax-financed programs have come to play a central role in a variety of settings. Second, it (...) examines citizen-level preferences that support this trend, arguing that employment vulnerability and threats to income continuity play a decisive role in shaping demand for public, rather than private, social protection. Survey data on labor-market risks and social policy preferences from eighteen countries corroborate these claims. Our findings suggest that other countries undergoing labor-market strains may experience similar demands for a “return of the state” as a guarantor of social protection in the coming years. (shrink)

In this paper, we make explicit the changing configurations of power relations that currently characterize the Brazilian Emergency Care System (SAMU) team in Belo Horizonte, Brazil. The SAMU is a recent innovation in Brazilian healthcare service delivery. A qualitative case study methodology was used to explore SAMU’s current organizational arrangements, specifically the power relations that have developed and that demonstrate internal team struggles over space and defense of particular occupational interests. The argument advanced in this paper is that these professionals (...) are developing their work in conditions of exposure, that is, they are always being observed by someone, and that such observational exposure provides the conditions whereby everyday emergency care practices are enacted such that practice is shaped by, as well as shapes, particular, yet recognizable power relationships. Data were collected through the observation of the SAMU’s work processes and through semi‐structured interviews. Research materials were analyzed using discourse analysis. In the emergency care process of work, visibility is actually embedded in the disciplinary context and can thus be analyzed as a technique applied to produce disciplined individuals through the simple mechanisms elaborated by Foucault such as hierarchical surveillance, normalizing judgment, and the examination. ResumoEste ensaio examina a sobrevida textual de uma cabeça — a de Antônio Vicente Mendes Maciel, o Antônio Conselheiro (1830-1897), a partir de sua morte na Guerra de Canudos (1896-1897). Traçam-se as figurações do crânio de Conselheiro na imprensa brasileira do fim do século XIX e nos trabalhos do médico legista Raimundo Nina Rodrigues e do engenheiro e escritor Euclides da Cunha. Embora ambos esperassem que o crânio de Conselheiro apresentasse evidências físicas de degeneração racial, as observações craniométricas de Nina (...) Rodrigues revelaram um crânio normal. Argumenta-se que esse fracasso da aproximação materialista à psique humana deu proeminência a explicações sociológicas para o fenômeno de Canudos, além de levantar questões sobre visibilidade, raça e racismo científico na virada do século XX e no mundo contemporâneo.Palavras-chave: Raça. AbstractThis essay examines the textual afterlife of a head—that of Antônio Vicente Mendes Maciel (Antônio Conselheiro [1830-1897]), after his death in the Canudos War (1896-1897). It traces figurations of Conselheiro’s skull in the late nineteenth-century Brazilian press and in the works of Raimundo Nina Rodrigues and Euclides da Cunha. Although these two social scientists expected Conselheiro’s skull to display physical evidence of racial degeneration, Nina Rodrigues’s craniometric measurements and observations revealed a perfectly normal skull. It is argued that this failure of a materialist approach to the human psyche allowed a stronger reliance on sociological explanations for the Canudos phenomenon that opens up questions on scientific racism and the visibility of race in the turn of the twentieth century and in contemporary times.Keywords: Race. Spoken communication between social robotic devices, powered by generative AI tools such as ChatGPT, and the senior population offers great potential for researching social interaction and robot identity perceptions as well as exploring the potential opportunities and challenges when implementing this human-machine interactions in real life situations and health care. In this paper we explore people’s perceptions of the social robot Furhat when administering verbal tasks similar to those used in screening for Alzheimer’s disease. We describe the Slovak system mounted (...) on the robot that includes a speech recognizer, the scenarios powered by generative large language model ChatGPT, and a speech synthesizer. We tested the functionality of the proposed approach with two groups of participants: attendees of a large science fair and a scientific conference. The observations from 87 collected questionnaires suggest good potential and applicability of such an approach for the given task and more positive attitudes of older subjects compared to younger ones. In The Grammar of Society, first published in 2006, Cristina Bicchieri examines social norms, such as fairness, cooperation, and reciprocity, in an effort to understand their nature and dynamics, the expectations that they generate, and how they evolve and change. Drawing on several intellectual traditions and methods, including those of social psychology, experimental economics and evolutionary game theory, Bicchieri provides an integrated account of how social norms emerge, why and when we follow them, and the situations where we are (...) most likely to focus on relevant norms. Examining the existence and survival of inefficient norms, she demonstrates how norms evolve in ways that depend upon the psychological dispositions of the individual and how such dispositions may impair social efficiency. In Norms in the Wild, distinguished philosopher Cristina Bicchieri argues that when it comes to human behavior, social scientists place too much stress on rational deliberation. In fact, she says, many choices occur without much deliberation at all. Two people passing in a corridor automatically negotiate their shared space; cars at an intersection obey traffic signals; we choose clothing based on our instincts for what is considered appropriate. Bicchieri's theory of social norms accounts for these automatic components of coordination, (...) where individuals react automatically to cues that focus their attention on what the norm is in that situation. Social norms thus act as rules for making choices in a social world where people expect others -- often unconsciously -- to follow the same rule. Some norms enable seamless social co-operation, while others are less beneficial to human flourishing.Bicchieri is famous for her interdisciplinary work on game theory and most recently her work on social norms, and Norms in the Wild represents her latest challenge to many of the fundamental assumptions of the social sciences. Bicchieri's work has broad implications not only for understanding human behavior, but for changing it for better outcomes. People have a strongly conditioned preference for following social norms, but that also means that manipulating their expectations can cause major behavioral changes. Bicchieri has been working recently with UNICEF and other NGO's to explore the applicability of her views to issues of human rights around the world. Is it possible to change social expectations around forced marriage, genital mutilations, and public health practices like vaccinations and sanitation? If so, how? What tools might we use? This short book explores how social norms work, and how changing them - changing preferences, beliefs, and especially social expectations - can potentially improve lives all around the world. Under the influence of the mysterious Ammonius Saccas, Plotinus conceived a desire to learn Persian and Indian philosophy firsthand. This led him to a romantic participation in the emperor Gordian's ill-fated Persian expedition. Developments in professional practice can be related to ongoing changes in relations of power among professionals, which often lead to changes in the boundaries of practices. The differing contexts of practices also influence these changing relations among health professionals. Legislation governing professional practice also differs from country to country. In Brazil, over the past 12 years, in a climate of deep disagreement, a new law to regulate medical practice has been discussed. It was sanctioned, or made into law, but with (...) some notable changes, in July 2013. Of interest to us in this paper are the ways the proposed legislation, by setting out the boundaries and scope of medical practice, ‘interfered’ in the practices of other health professions, undermining many ‘independent’ practices that have developed over time. However, even taking into account the multiple routes through which practices are established and developed, the role of legislation that seems able to contradict and deny the historical realities of multiple, intersecting practices should be critically interrogated. In this paper, we use the theoretical resources of poststructuralist thinking to explore gaps, ambiguities, and power relations implicit in the discourses that constituted this law. We argue that although the new law can be understood as a social and political device that will interfere in the organization of other health professions’ practices, such legislation is only part of what constitutes change in a consolidated professional practice. And while it is important to understand the effects of such legislation, healthcare practices are also realized or ‘made real’ through ongoing relations of knowledge and power, including, as we will see in this case, activities of resistance. The problem, then, is to understand the practical arrangements, including legislation, traditions and routines, values and knowledge that come to shape the practices of nursing in a particular context. This book articulates a participatory conception of deliberative democracy that takes the democratic ideal of self-government seriously. It aims to improve citizens' democratic control and vindicate the value of citizens' participation against conceptions that threaten to undermine it. The book critically analyzes deep pluralist, epistocratic, and lottocratic conceptions of democracy. Their defenders propose various institutional ''shortcuts'' to help solve problems of democratic governance such as overcoming disagreements, citizens' political ignorance, or poor-quality deliberation. However, all these shortcut proposals require citizens to (...) blindly defer to actors over whose decisions they cannot exercise control. Implementing such proposals would therefore undermine democracy. Moreover, it seems naive to assume that a community can reach better outcomes 'faster' if it bypasses the beliefs and attitudes of its citizens. Unfortunately, there are no 'shortcuts' to make a community better than its members. The only road to better outcomes is the long, participatory road that is taken when citizens forge a collective will by changing one another's hearts and minds. However difficult the process of justifying political decisions to one another may be, skipping it cannot get us any closer to the democratic ideal. Starting from this conviction, the book defends a conception of democracy ''without shortcuts''. This conception sheds new light on long-standing debates about the proper scope of public reason, the role of religion in politics, and the democratic legitimacy of judicial review. It also proposes new ways to unleash the democratic potential of institutional innovations such as deliberative minipublics. (shrink)

In this paper we introduce the concept of attentional scaffolds and show the resemblance between social media platforms and slot machines, both functioning as hostile attentional scaffolds. The first section establishes the groundwork for the concept of attentional scaffolds and draws parallels to the mechanics of slot machines, to argue that social media platforms aim to capture users’ attention to maximize engagement through a system of intermittent rewards. The second section shifts focus to the interplay between emotions and attention, revealing (...) how online attentional capture through emotionally triggering stimuli leads to distraction. The final section elucidates the collective implications of scaffolding attention through social media platforms. The examination of phenomena such as emotional contagion and the emergence of group emotions underscores the transition from individual experiences to shared collective outcomes. Employing online moral outrage as a case study, we illustrate how negative emotions serve as scaffolds for individuals’ attention, propagate within social groups, and give rise to collective attitudes. The norm, or behavioral regularity, is not to be identified with a single strategy. It is instead supported by several conditional strategies that vary in the frequency and intensity of sanctions.

O tempo é um grande tema para a fenomenologia. O atual artigo remonta alguns dos embates teóricos entre as primeiras teorias elaboradas por Husserl e Brentano sobre esta temática. É curioso notarmos que Husserl também se deparou com muitos dos problemas epistêmicos enfrentados pelo Brentano. No entanto, Husserl não tinha o compromisso de melhorar a teoria brentaniana, uma vez que o autor não quis continuar como um membro de sua escola. Conforme veremos, Husserl elaborou desde os seus escritos iniciais sobre (...) a temporalidade fenomenológica e a consciência-tempo, algo totalmente diverso daquilo que foi proposto pela primeira teoria do tempo de Brentano. The thesis of mental fragmentation has recently attracted increased attention as a way of explaining facts about mind and language. This volume provides an accessible introduction and essays on foundations and applications of fragmentation.

In this new study, Cristina Chimisso explores the work of the French Philosopher of Science, Gaston Bachelard by situating it within French cultural life of the first half of the century. The book is introduced by a study - based on an analysis of portraits and literary representations - of how Bachelard's admirers transformed him into the mythical image of the Philosopher, the Patriarch and the 'Teacher of Happiness'. Such a projected image is contrasted with Bachelard's own conception of (...) philosophy and his personal pedagogical and moral ideas. This pedagogical orientation is a major feature of Bachelard's texts, and one which deepens our understanding of the main philosophical arguments. The primary thesis of the book is based on the examination of the French educational system of the time and of French philosophy taught in schools and conceived by contemporary philosophers. This approach also helps to explain Bachelard's reception of psychoanalysis and his mastery of modern literature. _Gaston Bachelard: Critic of Science and the Imagination_ thus allows for a new reading of Bachelard's body of work, whilst at the same time providing an insight into twentieth century French culture. This article combines a pragma-dialectical conception of argumentation, a sociological conception of legitimacy and a sociological theory of the political field. In particular, it draws on the theorization of the political field developed by Pierre Bourdieu and tries to determine what new insights into the concept of strategic maneuvering might be offered by a sociological analysis of the political field. I analyze a speech made by the President of Romania, Traian Băsescu, following his suspension by Parliament in April 2007. I (...) suggest that the argument developed in this speech can be regarded as an example of adjudication and I discuss its specificity as an adjudication in the political field in an electoral campaign. I also try to relate legitimation as political strategy to strategic maneuvering oriented to meeting the contradictory demands of the political field, which I see—following Bourdieu—as involving a double political game, a game of democratic representation and a game of power. Dans cet ouvrage, RG propose une étude analytique des trois commentaires d'Averroès à la Physique d'Aristote – l’ Abrégé, le Commentaire Moyen et le Grand Commentaire. La force incontestable de son travail réside tout d'abord dans son approche double du texte d'Averroès, à la fois philologique et théorique. Tout (...) au long de son analyse, ces deux aspects restent intimement liés et la mobilisation des instruments philologiques n'est jamais une fin en soi. Cette analyse a en effet pour but ultime de reconstruire le système du monde tel qu'Averroès le concevait. L'enjeu fondamental de cette étude est alors de supplanter la vision d'un Averroès interprète servile de la physique aristotélicienne et de présenter sa conception de la nature comme un système cohérent, organique et original.
